I worked for a leading IT firm, was hired in India, and then transferred to the US. I was laid off in the US because of a lack of projects, and I was not given an offshore transfer back. I have 6.8 years of total experience, with 3.5 years in India and close to 3 years in the US. Am I eligible for gratuity, which is paid in India?

If your employment contract is signed in India and the transfer to the US was as per the requirements of the company, you are eligible to receive gratuity as per the Payment of Gratuity Act upon the termination of your employment. Accordingly, you will be entitled to receive 15 days of statutory salary (Basic + DA, if applicable) for every year of service and a fraction of service above six months, subject to a maximum of Rs 10 lakhs.

This thread pertained to 2013. Now the maximum gratuity has changed and it is Rs 20 lakhs as against Rs 10 lakhs in the past. Therefore, please read it as "subject to a maximum of Rs 20 lakhs"
