Hi all, I submitted my notice to my organization on June 20, 2012, intending to join my new company after a one-month notice period. However, just 10 days later, on July 1, 2012, my employer informed me of a security breach and terminated my employment immediately.

Issue with Relieving Letter

Now, my new employer is requesting my relieving letter from the previous organization. Unfortunately, my previous employer is refusing to provide me with either a relieving letter or a resignation acceptance letter. They have mentioned that my full and final settlement will be issued after one month, along with the termination letter.

Seeking Guidance

I seek guidance on how to proceed in this situation. Should I consider consulting with an attorney? Any suggestions or advice would be greatly appreciated.

Termination After Resignation

You can be terminated even after submitting your resignation. Some people begin to take things for granted after resigning. They start saying negative things about the company and may even attempt to steal files and data without consulting the Systems Department. If you have engaged in any of these behaviors, your case is weak, and the company can terminate you.

You need to check with your previous company as to the exact reasons for the security breach. What was the exact security breach attributable to you? Was a show cause notice issued to you or an enquiry conducted by the company? If not, then you can seek this clarification from the company, and you would have a good chance in the court of law. Consult an advocate.

The very first thing is that they can't terminate you without providing proper details of this "Security Breach." Have they issued you a notice, any information, or a letter regarding this? However, if you are found guilty, they have the right to take action against you, which would not be a good thing for you. You can share the complete details with us so that we can provide you with the proper solution to your problem. I feel like something is missing here, so let me request you again to furnish more details about it.

Termination and Documentation

Second, if they have terminated you, they should have issued a termination letter with a specific reason. Please let us know about it. Don't worry about your full and final settlement along with all dues and EPF; they cannot hold these indefinitely.

Previous Employer's Documentation

What about your previous/last employer? Why have they not issued you a relieving letter and resignation acceptance? Did you leave the job for some reason without serving the notice period and have been declared absconded? Why so?

You should be happy that they are not taking any action against you after finding a breach of contract. If they are ready to provide a letter after completing the notice period, you can submit it to your new employer. Additionally, you should clarify that you have not engaged in any illegal activities during your employment so that they do not delay your further settlement.

Please give us the whole story as Anil has requested. Also, kindly consult a lawyer if the organization has not given you any reason. The lawyer should be able to obtain that information by issuing a notice. Whether the new organization will still accept you depends upon the wording of the termination letter and the seriousness of the breach.
