there is a plant where offroll employee is daily working for 12 hrs do the demand of high production. it’s law fully right or not. please guide me....!!!!!

It is not legally right to engage people for more than 10 1/2 hours including intervals of rest. However, in case of emergencies like people engaged for urgent repairs without which the company may find it impossible to run the shift and may even lead to lay off, or such repairs without which a disaster can happen, engagement beyond the limit is permissible.

Dear Member,
Taking work from any person without entering his name in attendance register is itself unlawful. In general we are to take 8 hours work form any worker/employee. For OT, rest interval, spread over, etc. we are to go through the applicable Act.

Dear Janak, There is no such thing as 'off roll engagement' in a manufacturing concern. This is a balatant volation of the Factories Act and penalties would surely hit. There is no such thing as 12 hour shift. Once found out, this is ceratainly a disaster waiting to happen. Regards
