I want to know if it is mandatory to provide EL facilities to employees. According to labor laws, how many CLs and SLs have to be given? Is there any specific leave policy that has to be implemented for retired employees, I mean those who work after 58 years as well? Our company is a security services company.

For Shops Act - 15 PL and Factory Act - 18 PL p.a is Mandatory. And CL & SL can provide 12 p.a. but SL is not mandatory for ESI Covered Employees. Sebastian

Leave Provisions Under the Factories Act and Shops & Establishments Act

The Factories Act provides for EL (annual leave), and a factory, being an industrial establishment within the meaning of the Standing Orders Act 1946, needs to provide for CL as well under the Standing Orders. There is no provision for SL under the Factories Act. For providing SL under Standing Orders, please refer to your state's model Standing Orders.

If you are covered by the Shops and Establishments Act, you need to provide EL/CL/SL if prescribed under the A.P. Shops & Establishments Act since it is mandatory. Some states' Shops Acts provide for CL/SL besides EL, while others do not.

Leave Policy Overview

We provide 15 Earned Leaves (EL), 8 Casual Leaves (CL), and 6 Sick Leaves (SL) every year to our employees. Earned Leaves can be carried forward to the next year, while CL and SL cannot be carried forward and must be utilized within the same calendar year.

Leave Utilization and Notification

More than 3 days of EL cannot be taken at once. SL and CL cannot be prefixed or suffixed with other leaves or holidays, including Sundays and Saturdays. A one-week prior notification is required for CL, and a 15-day prior notification is required for EL. For SL, a one-hour prior notification is required. Only 3 sick leaves can be availed at any given instance.

Policy for Senior Workers

The same policy applies to senior workers who work after 58 years.
