My query is as follows:

1. We are a company incorporated under the Company Act.
2. Our factory and head office are situated in Dehradun.
3. We have a branch office/sales office in Gurugram (Haryana) where 4-5 employees are working.
4. Our factory and head office have all necessary registrations under the Factories Act and other labor laws.
5. I want to know if we need a separate registration for our branch office in Gurugram under the Haryana Shops and Establishment Act.

Please help.

Dear Raj,

Even though you have registered our company under the Companies Act and obtained a license under the Factories Act for your factory, you still need to acquire registration under the S&E Act of the concerned state if the office premises are located outside the factory premises.

As Mr. Bhaskar stated, you have to register separately under the Shops Act of the respective states since the branch and sales office are independent establishments under the Shops Acts.
