It is mandatory for the employer to pay gratuity within one month after retirement or resignation as per the Gratuity Act. First, write an email, or it would be better to send a registered letter to your employer requesting gratuity. If it is not done, then directly approach the labor officer or commissioner with a copy of the letter or email. It is your 100% right to have your gratuity, provided you have completed 5 years of service with your employer.

Prashant is right - you have only mentioned the 'situation/problem'. Solutions can be given to resolve the 'reasons/causes' to change the situation being faced. Please talk to the concerned official in the company and provide as many details as possible. The more inputs you give, the better the suggestions from this forum.

I am a new user and could not start a new topic (the top right link does not work), but I have the same issue. My mother was a state government employee as a lecturer. The government issued a circular in 2006 stating that the retirement date was in 2004! So my mother had already worked for 2 years. For those 2 years, she was paid a salary. Since January 2006, she has been on a pension. There was no overpayment on the part of the government, yet they did not release the payment of gratuity (which is usually done smoothly without any requests). No written order has been given by the government, but the word from the office clerks is that this money will not be paid because she worked for those 2 years. This does not make sense.

Steps to Address Gratuity Payment Issues

1) How can we get the communication from the government? Is there any format of a letter that I should write to them?
2) If they do not respond, what is the next step?
3) Is there an RTI act, etc., that we can take help of?

Thanks,
Deb
