Dear Somnath, never jump to a conclusion and decide to take legal action against your employer. Be polite and don't hesitate to approach your superiors and HR personnel.

Approach Through Proper Channels

Approach your superior without prejudice through the proper channels. Avoid going directly to the Board Director or Managing Director with a complaint, as it may lead to ongoing problems and potential traps at every level. Instead, contact your section in charge and the HR Department.

Inquire About Non-Payment

Politely inquire about the reason for the non-payment in November 2010. Ask for clarification on any deductions or recoveries that may have affected your payment.

Avoid considering legal action as your first course of action.

Warm regards,

Dear Sir/Madam, Regarding our previous conversation with my HR person, her reply was: "Your contract is over on the 14th of December 2010, and we regret to inform you. However, based on the verbal instruction of my boss, I continued my service. Up to this date, they have not paid my salary for November, December, and January. On the 1st of February 2011, I submitted my resignation via email and registered post.

Legal Steps to Recover Unpaid Salaries

Please advise me on the necessary legal steps to recover my salaries and other pending benefits. If I were to pursue legal action, under which act can they be implicated? What actions should I take for a prompt resolution in recovering my due money?
