Hi All,
One of our employee, appointed as QC Assistant, is on probation of six months. The management want to terminate him due to poor performance. Shall there arise any legal dispute if we terminate him along with one month notice pay.
There is clearly mentioned in his appointment letter that his service are liable to terminate during the probation period either side one month notice.
Please suggest.

Yes you can terminate him by giving him one month salary in avanced as you mentioned that there is a clause in appointment letter,



but terminate can not be solution.



95 percent copanies does not follow this procedure .This is totally failure of the company, how let me explain.

1) During interview what is your judgement for appointing a person.

2) Lot of money you spent for conducting interview.

3) Time spent for conducting interviews

4) reiembursement after interview and so on.



It is very difficult to appoint any person but termaintion is very easy.



What to do



you just give him memo from company side that your perfomance is not satisfactory after completion of probation period.

you have to submit ,why company continues your job. you must submit answers with in three days to concerned person.



After submitting you can extend their duty for next three months by giving memo that your performance must be improve and it should be judged after three months.



Termination is not the solution. most of the companies follows this rule.
