Dear Mr Bhaumik
You send a written complaint through registered post acknowledgment due to the Inspector of Factories about the non payment of your dues. If he is not responding follow it up with a petition under the Right to Information Act asking him to give in writing the action taken on the complaint. If he says that the employee is not covered by the Payment of Wages Act you can file a petition through a competent lawyer before the Government/Labour Court for a certificate to recover the money due as an arrear of land revenue from the employer

Dear Sir,
As per Maternity Benefit Act, she is eligible maternity leave for 84 days (12 weeks). She can avail 6 weeks before delivery and 6 weeks after delivery. She can also claim 84 days after delivery only. She is entitled full salary as maternity benefit. Regarding calculation, it is very easy. For instance: If she avails maternity leave from 01/01/2011 for a period of 84 days. She will get full salary for the months of January, February(31 + 28+25=84) and for the month of March she will get 25 days salary (Total salary divided by 31, since the month is March)
I think the calculation is correct.

Who is the concern authority for or Whom to contact/ make complaint for Maternity Benefit Act Labour office or Factory Inspector or the region?

Dear Member,
We are to contact the Inspecting officer of the area. Under section 14 of this Act the appropiate Govt. may by notification in the official gazette, appoint such officers as it think fit to be the Inspectors for the purposes of this Act & may define the local limits of jurisdiction within which they shall execise their functions under this Act. Thererfore approach the labour department of the area to find out the concerned authority for making a complaint for non compliance of M B Act, 1961 & the Rules made thereunder.
