Hi
I have signed a bond in company, attached is the copy of same.
Now as there is bond the employer is exploiting us.
Salary is not given on time, as well no other reimbursement are given for official work
I have completed one year and has the following queries.
1. Is it possible to break this bond.
2. No training and software has been purchased as indicated in bond.
3. HR is not giving reveling and experience letter.
4. HR is giving threat in case if we are not giving the bond money they will take legal action.

Dear Poonam,
Any agreement/ Bond which bounds an employee to serve any amount of period for acompany is not valid, so you need not wory you can resign anytime. If you want to resign on good terms you can resign on medical grounds. If bond was legal every employer would have had bonds / Agreements for 5 years or so and for 5 years there would be no attrition.

The issue you have raised, is subjective and should not be commented upon in general.

I assume that co. must have issued appointment letter to you also apart from this agreement. you have not elaborated on those terms.Pl. check whether co. has violated any terms of appointment?

My observations are that any agreement has any legality or not depends upon the contents and terms af the agreement .On the face of your agreement there appears to be no illegality.It is an instrument by which two parties agrree to act upon and binds themselves for a certain period.

you have signed the document with free will and full understanding of the implications.If you contravene the terms, naturally you are liable for the consequences.

It would be wrong to comment straightway in general that all bonds/agreements are illegal.

One more point for all members to think upon:

By asking ways to break the bond through the platform like citeHR would be ethical and correct ?

If you have grievances against the company and feel exploited , there can be many other internal forums in the company itself and you can raise your voice there before finding ways to break the bond.

If any such bond is not registered on the stamp paper and simply given in the appointment letter that you have to stay upto 2 yrs or so; than is it valid ?????

Dear Rohit,
The bond is fully illegal because of the consent dont' have consideration on employer side.Bond would be valid in only case if the terms & conditions are necessary for both the party as employer would be also restricted from retrenching, this is not mentioned in bond so according to Indian Contract Act the bond is invalid.There r many other resons for the bond become viod.
So you can definitly change the job at any time on your will.

As i have analyzed that agreement is made at the time of appointment by the employer and at that time employee is agree as per given term and conditon, because he was totally unknown about company environment.
After some period he is understanding the company policy and and understanding positive and negative impacts emposes upon employee.
if bond is 100% valid then every employer will follow the same and after it will not follow any statutory and can be attrition rate zero
you can give the application regarding your issue and if HR and concern department is not taking appropriate action you can be resign. As per the approintment letter mention notice period you have to follow the notice period.

Dear Rohit,
Bond is illegal. A Company can only take action when employer and employee prepares an agreement (on stamp paper) with the understanding that the company will provide training to the employee and the employee has to work for a period of _ no. of years. Agreement also states the cost of training incurred by the company and the amount the employee has to pay in case he wishes to terminate the employment before the said period. Only in such instances, the company can take legal action against the employee.
Any other bond is illegal as no Company can legally bind you. Such documents have no value. The only important document is the Appointment Letter.

As two of the employees have resigned from the company. but the HR has forcibly taken the Bond amount form them. In case the employee are not ready to give the bond amount the HR is not issuing the reliving letter and service certificate.
With several discussion with HR they insisted only one thing that the certificate and clearance letter will only be given after the submission of Bond amount. And the company we are going to join require the above mentioned documents.
We have also told HR that as per the bond they have not fulfilled even the Training and no software is purchased for our stream and most of the software are pirated.
Pl. suggest.

If a person has not signed any contract, but given a cheque of certain amount, then how can we stop company to use that cheque
