Dear Nitin, You have to maintain all the registers as per the Contract Labour (R&A) Act. Ensure all statutory requirements are fulfilled, such as:
- Adequate toilet facilities provided (1 toilet per 25 workmen).
- Washing platform, resting place, and canteen facilities.
- If the workmen strength is more than 500, provide a doctor and a labour welfare officer.
- If female workers are deployed, provide a crèche for the children.
- Provide potable wholesome drinking water.
- If accommodation is provided outside the work area, offer conveyance vehicles for transporting the workforce from the labour colony to the site and back.
- Wages should be paid by the 7th of every month.
- Ensure double overtime payment, etc.
Display a notice board with various acts (Child Labour Abolition Act, Minimum Wages Act, Payment of Wages Act, Contractor Labour Act, Gratuity Act, Workmen Compensation Act) in English, Hindi, and the regional language. Ensure a labour licence and registration of establishment certificate are available.
Maintain half-yearly and annual returns filed regularly, register of workmen, register of subcontractors, register of fines, register of advances, register of damage or loss, register of muster roll, wages, overtime, employment card of all workmen, and full and final settlement of all workmen who have left.
Even if you maintain all the above records and statutory obligations, the labour inspector may still point out discrepancies. They might note that sanitation is not maintained properly, adequate lighting arrangements are not made, or workmen are not paid as per the Minimum Wages Act, or any other issues they perceive.
However, if you maintain a good relationship, the inspector will come directly to your office. With good comments, they will leave your office.
