Query Regarding Labor License
I have one query regarding a labor license. A contractor has a license and some contract work in an industry. Now, he has obtained some other contract work from another company in the same area. My question is whether he needs to get another labor license or if his existing one will be applicable. Please clarify.

You have to apply for another labor license for engaging contract workers for that establishment if the Contract Labour (R&A) Act, 1970 is applicable to you.

I want to know about the license processing. We have recently received an order from GSECL for the EPC of a power project. GSECL is the principal employer, and my organization has subcontracted to another company. In this scenario, do we need to obtain a labor license? My organization does not directly employ any labor for the company; instead, we only supervise the subcontractor. I would appreciate your assistance on this matter.

Dear Pranav, In my opinion, if you are not employing any contract labor as per the definition of the worker provided by the Contract Labor (R&A) Act, 1970, or employing fewer than the required number of workers for the applicability of the Act, then you are not required to have a license. According to the definition of 'contractor,' sub-contractors are also covered; therefore, if your subcontractor is employing the required number of contract workers for the applicability of the Act, then the subcontractor is to have the license. For the license process, please go through your applicable Contract Labor (R&A) Rules.
