Dear friends,

Please send me a PPT or PDF file regarding PF-related details, such as the procedures for obtaining the PF number for the factory and the steps to follow after an employee joins to allocate the PF number to new employees. PROVIDENT FUND

----------------------

The Employees Provident fund and Miscellaneous Provisions Act, 1952 is a social security measure aimed at:

- Promoting and securing the well-being of the employees by way of provident fund, family pension, and insurance to them.
- Inculcating a habit of saving amongst workers.
- Providing a steady workforce to the employers and
- Assisting the government by providing funds of considerable magnitude for utilization on various projects meant for promoting economic and social development of the country and the well-being of its people.

The Act shall apply to:

- every establishment which is a factory
- engaged in any industry mentioned in schedule I of the Act and
- employing 20 or more persons or
- any other establishment employing twenty or more persons.

For the registration, the establishment must submit the PF form to the regional office of EPF. After the registration, EPF organization is issued a code number. This code number is used for all further communication to EPF organization.

All employees in such a factory or establishment, including contract labor but excluding casual labor and receiving wages up to Rs. 6,500/- per month, will be regulated by the provisions of the Act. Trainees and apprentices are also not included in the determination of the numerical strength.

CONTRIBUTIONS

An employee may contribute 12 or 10%, as the case may be, of the basic wages, dearness allowance including the cash value of any food concession and retaining allowance. The employer will pay @13.61%.

The breakup is as follows:

Filing of returns

- The employer shall, within 15 days of the applicability of the Act, send the particulars of all branches, departments, owners, occupiers, directors, partners, or any other person in charge of and responsible for the conduct of business, in form (Return of ownership), in duplicate, to the commissioner.
- In the event of any change, the same too should be intimated within 15 days to the regional commissioner.
- The commissioner shall, on receipt of the return of ownership, verify the particulars submitted therein and after having been satisfied, allot an establishment code No.
- This code shall be mentioned on all forms, challans, statements, returns, and all future correspondence.
- A return in the prescribed form 5 in respect of employees qualifying to be members of the fund for the first month during the preceding month shall be filed within 15 days of the close of every month and sent to the CPFC.
- A monthly return of contributions in the prescribed form 6 has to be filed with the commissioner within 25 days of the close of the month.
- An annual return of contributions in form 6 A reflecting the employer and employee's contribution in respect of each employee is to be submitted within one month of the close of the period of currency to the commissioner.

I resigned from a company for personal reasons after working just a month. As stated in my appointment letter, I served the company a 7-day notice. Upon joining, I filled out the PF form. However, upon resigning in the 3rd week of the month, I verbally requested the company not to deduct PF from my salary. To my surprise, upon receiving the final statement, I noticed that the company had already deducted my PF. When I inquired with HR about this, as I had resigned in the 3rd week of the month, I questioned how it was possible for this deduction to occur before receiving my salary, given that most companies calculate staff salaries at the end of the month or in the first week of the following month. They explained that my PF deduction had been processed along with other staff contributions and provided me with the PF account number. Additionally, they had also deducted gratuity, PT, etc.

As the company has not provided satisfactory answers regarding these deductions, I have refused to accept my final settlement, resulting in a deadlock. I am seeking clarification on whether the company's explanation is accurate and why they cannot provide me with a receipt of the PF remittance as proof. If I were to accept the salary, it would be challenging for me to claim the PF since the company would need to process the paperwork for cancellation, as I do not intend to transfer the PF. Should I choose to cancel the PF, would this action lead to any issues or conflicts with my new assignment? Moreover, what is the procedure to recover my full salary from the company? Should I explore legal options, and if so, whom should I contact? Your valuable suggestions are greatly appreciated.

PF not received even after 9 months. I applied for my PF 9 months ago, and I have still not received it. I keep asking my previous employer, and they tell me that they have sent the requisite forms, but there is no sign of my PF money. They then asked me to re-apply, but even then, I have not received my PF. I just do not know what to do. Even the PF website is not working. I am at my wits' end.

ANYONE KNOWS WHAT SHOULD I DO....????

My Question Regarding PF Scheme

I was working with a company until November 2012 and was a part of the PF scheme. After that, until March 15, 2013, I was running my own business. Now I have got a job and am joining a company again. My questions are:

1. Can I withdraw the amount of PF from the previous employer?
2. Can I opt not to be a part of the PF Scheme during my new employment?
