Hello All,

I am working in a startup pharma company's HR department and am pretty new to HR/IR rules and regulations. I need your guidance to understand how to apply a leave policy for our company. We have office staff of about 100 and sales staff of about 1000 within India. Your advice/suggestions are highly appreciated.

Dear Hilpa,

Just check whether the company is enrolled under the Shops & Establishments Act and works according to the law of the S&E Act. You will then be able to determine the entitlement of employee leave.

Dear Shilpa,

Sumiksha is right. Please find out under which labor statute your company is registered. If it is the Shops Act, then the leave rules provided under the same will prevail. If you also have a plant, then the Factories Act will apply.

The leave rules contained in both the labor laws are very easy to understand. Make the small effort of reading both the acts, and you will arrive at the answer you are seeking.

For preparing a leave policy, you can also refer to your state's applicable Shops & Commercial Establishment Act.

Hi Shilpa,

I suggest that you prepare common leave rules for both the office and factory for easier administration. Additionally, I recommend conducting a survey on the leave structures being implemented in other similar pharmaceutical companies in your area.

Dear Priti, Purchase the bare Act on Shops & Establishment Act of your State from any shop keeper or inquire from him the name of the book-seller who is having law books.

Mr. Khola beat me to it. Yes, as advised by him, go to any shop which sells Legal Books. Ask the shopkeeper for the Shops & Establishments Act applicable to your State. Then designing a Leave Policy will be very easy.
