The workmen who are not covered under the ESI Act, 1948, and are covered under the Workmen's Compensation Act, 1923, are entitled to benefits under this Act from the employer. However, in this case, it is not necessary to have a WC policy as the employer may provide compensation from their own account. They take a WC policy to avoid any sudden liability due to any mishap. Now it is up to you to have or not have any WC policy.
