Dear All,

Could you tell me about the EL & CL?

Dear colleagues, where I am working, there are no E.L & CL benefits available. Therefore, we are looking to implement E.L & CL policies. Kindly advise me on how much EL & CL we can implement in our organization. Does it depend on the management, or can we calculate it using the following formula:

365/20 - to find out the EL
365/60 - to find out the CL

Is this correct or wrong? If I am mistaken, kindly correct me.

Dear Meenu,

First, examine which of the Acts, i.e., the Factory Act or the Shops Act, is applicable to your establishment. Then, review the provisions for EL. If the Factory Act applies, refer to your State NFH (Casual & Sick Leaves) Act for granting CL. Otherwise, look for the CL provision in the Shops Act.

Dear Meenu,

The calculation you have made for EL is not correct. First of all, you have to mention what Mr. Khola has asked because the quantum of leaves varies in different states and from factory to establishment covered under the Shop Act. You need to clarify your establishment's location and the type of industry before you can get a clear picture; otherwise, you will not receive the correct suggestion.

As per your statement, your Motor Transport undertaking seems to be covered under The Motor Transport Workers Act, 1961. In accordance with Chapter VII, you are to give Earned Leave (EL) to the motor transport workers. Since you are employing more than 100 workers, you are also covered under the Industrial Employment (Standing Orders) Act, 1946, and the Rules made thereunder. This Act and its Rules also provide provisions for EL, CL, SL, and holidays. Please review your State Industrial Employment (Standing Orders) Rules and ensure the Standing Orders are certified by the Certifying Officer.

For maintaining records of fines, advances, deductions for damage or loss, etc., you may purchase these registers from a book-seller in your city and keep them updated. These registers are required to be maintained under the Minimum Wages Act, 1948.
