Please help me out with the issue below. I'm in a very difficult situation. I have been an employee of a certain company. I joined that company as a fresher and worked there for more than 2 years. In my company, employees are required to serve a notice period of 45 days. However, I fell short of my notice period by 30 days. I informed my employer that I would be serving a notice period of 14 days, but they refused. I even asked to buy out my notice period, but they didn't agree. Due to having another job offer and their urgent requirement, I did not serve my full notice period.

Now, after 1 month, my current employer is asking for a relieving letter. When I approached my previous company, they informed me that they would not provide a relieving letter and labeled me as an absconder who had been terminated. It's important to note that they conducted my exit interview. They sent an absconding letter in their records, but I have not received any letter from the company yet. They claim that they have sent the absconding letter to me.

Can anyone help me with this situation? Could someone advise me on whether I can obtain my relieving letter from my previous employer or take legal action against the company? Please respond to this question. My career is at stake...

You should request your previous company for a relieving letter or ask for acceptance of your resignation letter. Also, talk to your current employer's HR person about this situation, but don't tell them that your previous company is saying that you are terminated. Just inform HR that your previous company is not providing you with a relieving letter. If you have some good contacts in your previous company, you can provide their references to your current employer so they can verify. However, remember that when you leave a job, you shouldn't spoil relations with anybody because you may need anyone at any time. It's better to maintain good relations. Even if you secure a good job, don't jeopardize it, and never assume you won't need them in the future.

You can ask your current HR department for understanding in your situation and submit all your salary slips. Please keep me informed of any developments.

Thank you very much, Pooja. However, what has happened is that my manager has given a good review on my side, but the only black mark is that I've absconded. I will try to ask my HR about this situation. Am I still entitled to receive the relieving letter even in this worst-case scenario? I will keep you updated about my discussion with the HR team. Yes, they can deduct your pay, but they should give you a relieving letter or an acceptance letter. Anyways, if your HR is really HR, then they will help you or guide you about the same. Don't worry.

Hi,

I would like to intervene in this if you don't mind. I have a few clarifications in this regard. Why is your present employer insisting on a relieving letter after such a long time - one month after joining them? Was it not communicated to your present employer that you would be serving a shorter notice period with your previous employer? You should have either convinced your previous employer or your present employer regarding the notice period and the date of joining. Anyways, let bygones be bygones. Now, all you can do is meet with the HR of your present employer and explain what actually happened with your previous employer. Also, explain the difficulty in obtaining a relieving letter from your previous employer. If your present employer had a system of proper background verification and formal joining procedures, you would not have been put in this situation.

Very best of luck to you - discuss and explain things to your present employer instead of approaching your previous employer as it may worsen your relationship with them. Please keep us informed of any progress in this regard.
