Dear All,
We have many workers at our Factory who are continuing on contract basis/ retainer basis after their retirement. Since they are no more in our payroll we cannot cover them under ESIC, we need to come out with concrete proposal for their medical/accidental coverage so that in the event of any unforeseen situation both the workers and Management are protected.
Can WC Act apply to these? What are the other alternatives. Need all your suggestions urgently.

Dear Debapratim Guha,
As per ESIC act any person employed whose salary is less than Rs. 15000.00 has to have ESIC. As a principle employer your company has to pay ESIC for such contract work force.
There is no substitute to this provision. If not done and if in case of any accident, there will be a problem.
Alternatively you can route these employees through some registered contractor who has ESIC registration.
Now a days ESIC is to be applied online and we follow this requirment strictly.

Dear Mr. Sudhir,
Then what you are saying is that the workmen who are retired and then kept on retainership basis can be covered by ESIC?
The second option cannot be done as they are already under retainership and changing their nature of employment and making them work under a contractor may not be a good idea.
