Hi,
For every completed years of service in excess of 6 months ,the employer shall pay the gratuity to the employee at the rate of 15 days of wages based on the ordinary wages last drawn by him by 26 & multiply the quotient by 15.
So,If somebody cross 4.6 ,He is entitled to get for gratuity .

Dear Banani,
Your condition will apply only in case of a deceased employee or person who has served more that 5 years. ie. 5.6+, 6.6+, 7.6+.
For less than 5 years the employee has to serve more than 4.8 yrs i.e. 4 yrs and 240 days.

Hi Amit,
There is no such criteria in the act. This logic is applicable after completion of 5 Years of service.
4 Years +240 working days are minimum requirement for Gratuity and if anybody worked more than six month above the five years will be treated as one more year.

Dear friend For calculating the Gratuity the employee is eligible from his Training period onwards. Hence there is no confirmation needed for calculating gratuity. regards alphonse
