Hi all, actually i want to know is it mandatory to give EL facility to employees. According to labour laws how many CL's & SL's has to be given. Is there any specific leave policy that has to be implemented for retired employees, i mean who work after 58 years also.
Our's is a Security services company.

For Shops Act - 15 PL and Factory Act - 18 PL p.a is Mandatory. And CL & SL can provide 12 p.a. but SL is not mandatory for ESI Covered Employees. Sebastian

Dear Shailaja
While Factories Act provides for EL(annual leave) and a factory being an industrial establishment within the meaning of Standing orders Act 1946 need to rprovide for CL also under the standing Orders. There is no provision for SL under Factories Act and for providing SL under standing orders, please see your state's modelStanding Orders .
If you are covered by Shops and Establishments Act, you need to provide EL/CL/SL, if so prescribed under the A.P.Shops &Establishments Act since it is mandatory.Shops acts of Some states provide for CL/SL besides EL while others do not.

We provide 15 EL, 8 CL and 6 SL every year to our employees. Earned leaves can be carried forward to the next year, CL and SL cannot be carried forward and must be utilised within the same calender year. More than 3 days of EL cannot be taken, SL and CL cannot be prefixed or suffixed with other leaves or holidays inlcluding sunday and saturdays. 1 week prior notification required for CL and 15 days prior notification required for EL. 1 Hour prior notification required for SL. Only 3 sick leaves can be availed at any given instance. Same policy applies to senior workers who work after 58 years.
