Suggestion required from you all, in case of accident during official duty( fatal/non fatal) if the workman is not covered under any insurance policy( ESI/WC/ etc.) what is mandatory liablity of principal employer/ principal contractor in case of monetary support or demand from the family of deceased or injured.

In respect of an employment injury sustained to an employee not covered by ESI or whereas he is not a worker as defined in section 2(n) or schedule II attached to Workmen's Compensation Act, 1923, the liability of payment of compensation rests with the Employer only. The amount of compensation shall be worked out with reference to fatality of injury and loss caused to earning capacity due to the said injury. It is possible to work out the compensation in the manner prescribed under the WC Act itself.
