Dear Sir,
As per bombay shops and establishment act, only 42 leaves can be accumulated and rest of the leaves can be forfitted by the company. But its totally depend upon the policy of the company..the formula for leave encashment is..
Basic + HRA
.................... x number of days to encash

Dear Prasad,
For the first query, you cannot make encashment of leave with the respective year salary.
You should make the payment as per the last drawn wages/ salary.
And let me know your organisation fall under Shops and establishments act or Factories act, so that I can accordingly suggest whether you need to make payment on Basic + DA or gross salary.

Dear All, Earned leaves encashment depends on the company’s policy only. Im supporting priyas statement. Company should decide whether they will give on basic salary or others. regards, narayan

Dear Deepak,
Tks for the information..
One thing people are not understanding, when they take leave they want to have their one day salary (from Gross) and when they encashing it they expected from Basic + DA. How the logic will match???
I am strongly supporting all others who have said Leave encashed from Gross sal
Tks
