Dear Roopesh, When a person commits suicide, and he writes somebody's name holding the person responsible, the person so named comes under abettment to commit suicide, but that only becomes an allegation. It needs to be proved in a court of law. With so many Farmers committing suicide have you ever seen any money lender,official or minister getting arrested?? So, a person just cannot put anybody's name, there must be a relation in which the accused had created wrongful threat perception, coercion or intimidation that the person had to end his life. The term wrongful should be there. So, it is always advisable to go in for full disciplinary proceedings (Domestic Enquiry) before terminatinmg an employee. Once that is done then you are absolutely safe from law. Informing Police station will not protect you, because if the Company's name is there it will have to appear in court, and in court if it is proved that the Company had terminated without proper domestic enquiry or had made the person forced to resign, then it will be real trouble. dear friend, He is a professional fraud. As you have informed police, you should inform his family in writing about the whole incidents. As you have suspended him, not terminated, you are bound to conduct enquiry before terminating his service. The day you came to know the fraud, you should be terminated his service. Don't keep any further delay. But it is clear, he is just emotionaly black mailing and you don't consider all these nonsense. Good Luck, shiv Kumar

Hi, See first of all, this type of person cant do any thing good for the organisation in future also. But to get rid of him, i appreciate the measures suggested by both Sam and Roopa. Lets start with this measures. Out come will come automatically and may be we get some new avenues to overcome the situation. Informing local police, involving family members & close friends, taking legal suggestions etc. are good steps to deal with this type of situation. Every measure from company side should be documented. After all, life is precious and the more, life(s) related with that person. rksarkar

Hi, In this instance one probobale acation is that you could ask him to resign and hence not terminate him. Termination is a life long impacting action which will be visible in all records exxpecially when background screening is done. Tell him that we are not terminating you, tell him to make a graceful exit sans the notice period. If this love approach doesnt work then its time to act tough! You could report this to the Indian Labour commission first and get thier notice. Then with the help of lawyers and the judiciary expedite his termination Regards, Kenneth

Hi I Agree with Rupa, you may make evidence ready inform police, others in the office, mgmt , union reps if any... and his family members too.also involve some media people, those ppl need not live on this earth like this, there are no legal complications involved for you once u secure evidence.. and dont allow people like these to balck mail you. Do remember always , those who do emotional balckmailing, one you give them elbow room , they will stab you in the future for sure, at the most if u think he is valuable as a human being at the least , hand him over to a pshyciatrist, never get involved in his treatment once his family members are informed! all the best!

Dear Roopesh, All the ideas given by our members are exellent As per my suggestion, 1. formal information to local police station 2. information to their family member - if married to his wife, if not to their parents by arranging a formal meeting at your office 3. in this case, consider you organisation size also, because if it is smaller one you can retain him, because as a humanitarian approach, person who makes mistake and identified, will not repeat it again and also will try to work trustfully to his boss and in the other case, if the organisation is larger size, as Mr. samvedan told, you have to deal in tricky way, like, you need to make him shy everyday whenever he comes to office by highlighting the matter to his other collegues informally and this will make him to quit the job automatically even less than a month...
