Engaged manpower contractor for the supply of Man Power of the unit for a long period and subsequently terminated on Dec 2018. As the employer failed to pay contribution of both employee & employer from April 18 to Dec 18, The contractor has also not remitted the contribution on ESI & PF.
Now supposedly, the employer chooses to pay contribution to the contractor for 10 out of 20 employees of the contractor, will the PF system accepts of the contribution of those employees of every month April 18 to Dec 18. whether the employee of the contractor shall initiate for the settlement of claims.
ESI - Whether we can pay in terms of contributions to the contractor so as to pay the same for their employees of the period Apri 18 to Dec 18.

if the contractors employees are registered in principal employer code, then they can go smoothly, if not registered but mapped under contractor then also they can, but if they are not at all registered then they have to approach the PF Commissioner along with their documents viz contractor license to depute the labor contract and the master roll of employees,

on the Merits of the documents submitted, and (if needed) a personal hearing, the commissioner may pass order to accept the contribution of contractor based employees.

if mapping is done then there is no issue to submit ESIC contribution, however it is time barred case, so the PE has to submit the salary sheets to ESIC reginal director, who will issue 19C for payment( it may vary from the sheet as it would contain assessment figure)
