you have to register your establishment with the Controlling Authority at Chennai who is normally an Aasst Labour Commissioner notified by the State Government (assuming the Government of Tamilnadu is the appropriate governemnt for you). So far as the procedure is concerned, the same is governed by the Gratuity Rules of Tamilnadu.However as per Rule (3) of the Central rule, an establishment within 30 days of the rules becomimng applicable to it, shall submit a notice in Form 'A' to the Controlling Authority. The procedure may be the same under Tamilnadu rules. Please confirm this before proceeding to register.

Dear All,
My case is little different,one of my employee who has worked as casual worker for about six years got permanent abortion as per his educational qualification. He further, served as Employee on contract for another 05 years.
Now he has resigned from company. We do not have his record of casual period but account dept has confirmed that they has payment vouchers with them.
Kindly explain, how to calculate his Gratuity ?

Dear Vaishali,
the eligible for gratuity is completion of the five years of continuous service in case of he alive.In case he dies his nominee even after completion of one year claim the gratuity benefit.
