Was the employee on duty during the time of death? if yes, and if the person was under ESIC, then that person is eligible for ESIC also.
Regarding your PF query for death, you need to follow the below mentioned procedures:
1. Collect from 20, 10-D and 5(IF) .
2. Collect the surviving family member certificate duly signed by the employer after getting it verified.
3. Collect legal heir certificate of the surviving member.
4. Attach the death certificate and identity proof(preferably aadhar card ) of the deceased employee of the deceased employee.
5. Attach id proof along with the passport size photo being attested by the employer of the family members those have filled the forms as mentioned above. Please ensure to ask the family members those who have mentioned themselves as claimant, their bank a/c should be from the same branch.(SBI a/c is most preferably)
For any further support you can see help of your claim settlement officer of your pf office.

## Employee Provident Fund amount is paid to the nominee that was nominated at the time of initiation of the account. If there was no nominee assigned then the EPF amount is paid to the immediate members of the family. If the family members and the nominee are not applicable for the account then the legal heir can claim the EPF amount.
Firstly you should checked the Nomination form knows which family member's has been nominated there then after that you can proceed for further.
## Following are the guidelines for the same.

-For married employees, claimant can only be the spouse and kids (up to three) below the age of 25 years
-Each claimant is paid the equal proportion of the total calculated amount for both PF and Pension Fund
-Provident Fund amount is paid in one time. However, Pension Fund is divided into equal monthly installments
-All the funds gets transferred to the claimants through NEFT
-All claimant's bank accounts should be with the same bank
## Documents required to claim PF in the given situation are as mentioned below:

-Duly filled and signed attached forms
- Composite Form 20/Form 10 D/Form- 5 IF (1 or 2 copies )
-Joint photograph of all the claimants
-Employee's ID Proof
-Each claimant's (parent and spouse) ID Proof
-Birth Certificate for the kids of the employee
- Death Certificate
- Joint photograph of all the claimants
-Scheme Certificate (if applicable)
-For verification of bank accounts, a copy of cancelled cheque or attested copy of first page of bank Pass Book.
**Please make a note that All death case claims submitted by spouse or nominee or legal heirs of EPF members be invariably settled within a period of seven days from date of submission of claim form in concerned field office where the deceased members accounts are being maintained.

We were exempted U/P 28 (7) & paying contribution to LIC since 1990 without break. In 2015, when we applied for further exemption EPFO refused by saying that as per our head office circular dated 6/2/2017, we can not grant further exception to any industry. We had no option & from February 2017onward we started paying contribution to EPFO instead of LIC, In June 2017 one of our employee expired but EPFO refused to pay 100 % claim of Rs.6 Lac to widow of member,while he was regular member of EPF since 1990 & basic salaru was 20590 till death. EPFO paid 3.75 Lac against 6 Lac maximum benefit under the scheme
What is the legal obligation on this case.

However, verify his/her EPF Form 2 (Nomination) under family clause. Find out any changes is informed by her/ him. Has she/ he given Form F under gratuity Act verify that also with Form 2. If married wife alone. incase of any child major they also ( upto 21 years female) otherwise minor means guardian i.e mother or grand parents. You have to get their identity confirmed before acting further.
