If an employee in manufacturing industry works for four years 10 months, Is he eligible to get his gratuity ? Pls give your valuable suggestions.

The employee worked 4 year + 240days in the 5th year of service is eligible for payment of gratuity, But it shouldn't be overlooked that in each year the working days must be 240days because 240days=1year of service.

Dear Sumit kumar saxena,
Thank you somuch for your information. But where did mention the 240 of service in fifth year is enough to eligible to get gratuity.
When i gone through act it clearly tells that the candidate should complete five years compulsory. But in one case in the Tamilnadu, Madras high court issued an order as you said. But shall we take that order as reference to consider an employee for eligibility ?
Our factory is situated in andhra pradesh.
If any judgement passed in this, pls give me the details for reference.
