I am an Asst. Professor. I was working in a private college since last 7 years. Now I got a good offer from a University, I informed my immediate Head as it was a good opportunity for my career with a good hike and she was fine with it. I wrote a resignation and got it forwarded from her that to be relieved by 30-6-15 because of good conduct and I submitted it to the College Director on 5-6-15 and informed that I would serve the 1 month notice period and requested to be relieved by 30-6-15. With 6 CL and 3 AL in my account.

Since I was associated with an important task of admission as a core committee member within the organisation I also informed the Admission's Director but he was not willing to relieve me as being an old employee he wanted me to stay back till the admission process goes on and work for 1 another month, in the mean while I had completed all major task required under my job profile and also offered to train a person who could work as a replacement for smooth working of the admission process. Since I was taking care of marketing and advertising related work, majority of the work was completed and only modification was to be done with a DTP operator. But he did not agree. I also asked him if he wants me to stay back they negotiations can be done with my current salary. But he did not answer. I could not even avail my leave in account because of the admission process as no one is allowed only in emergency.

I informed the Admission's Director politely 2-3 times that I have to join on a specified date as a new session begins in my new work place and they require me now else they will drop my candidature and search for new one, He was not willing to relieve me on my last working day. I had sent the resignation by my official email on 26-6-15 mentioning the resignation date to my college director and head and cc to my personal mail id. I also requested on the last working day to my College Director to let me start the F & F process and complete the no dues formality but he informed that since the Admission's Director is not giving me NOC we can't start your exit process. Now on my resignation a note has been put by the admissions director that not to be relieved before 31-7-15. My salary has also been put on hold.

I joined my new job on 1-7-15 and gave a copy of resignation with a seal of receiving from director office. They have considered it and given time to me.

Please suggest what legal action can be taken if my salary is not released or experience certificate is not issued after 1-08-15.

This is a typical scenario in educational institutions.
Teaching staff do not get relieved easily.
The excuse that some academic work is pending is a useful bogey.
You have worked during the period and no one can legally stop your pay just because you have given notice for exit.
If they do not pay you your due salary,you can go ahead with legal remedies.

yeah off course if they are not paying your full & Final just go to Labour Court. And just give a demand notice through labour commissioner
