Hi All,
I am new member to this forum.
I have a query regarding working hours defined as per law for IT Industry
I work as a HR Executive in a small IT company based in Hyderabad and the standard working hours in this company is 9hrs including 45min of lunch break and we work 6days a week without overtime pay and only Sunday is a holiday. I have worked in a company before in Bangalore and we had offs on Saturday as well in fact most of the Software Companies in Hyderabad as well do not work on Saturdays. I want to know whats the legal working hours assigned by government (specifically for software companies)?

The std working hrs in a company as per law is 8hrs . most NON IT companies have a 6 day week with an off on Thursday or Sunday. The concept of weekend offs is subjective to an organisations internal policy , over the last couple of years most IT companies have given the benefits of weekend offs to their employees .
But with the recent fluctuation in the exchange rate, the profit margins for the companies have declined hence most IT companies have added an extra working day on saturday instead of extending the working hours each day.
On an avg an individual is required to contribute to 8 hrs of productive work, but generally employees take their liberties in terms of taking frequent and long breaks hence the working hrs exceed to 9-10 hrs.

Working hours in a factory as per laws prescribed in Factories Act, 1948 in a week are 48 and not more than 9 hours in a day including lunch break. As per rules week commences on Saturday midnight and ends on Saturday midnight. Mostly, the weekly off is given on Sunday. However, if any company wants to change the day of weekly rest, they can change but subject to the condition that they have to inform the concerned authroities of Labour & Employment Department i.e. Inspector.

The working conditions of IT Professionals in India is indeed very pathetic... anyone who has had an onsite opportunity would agree with me on this... The problem basically rests with in us... Since we are the youth we don't prefer democratic motions and don't get into protests... I guess no one knew that there was a IT/BPO Union in India, and they are now presenting our case against longer working hours... We need to bring our voice to the minister for Communication and Information Technology, Mr. A. Raja... and even to the prime minister... Have a look at this article in the facebook group
IT/BPO Voice of India | Facebook
read thru it and if you feel you should be a part of it join and participate in the revolution Voice of India (For greater India)... We need to spread the message...

Hi Deepak,

you could try <link outdated-removed> ( Search On Cite | Search On Google ) it the premium union for IT/BPO in India.

also read though the posts

where a pvt ltd companies employee can make complain against his company, if company terminates him without any reason or notice, and without clearing dues? - Ask or Answer Law Questions - ibibo Sawaal Expert Answers <link updated to site home> ( Search On Cite | Search On Google )

Alternatively I would urge you to join the above posted link on facebook or create a community in Orkut. I haven't done that of yet and you could spread the message. All communities or groups created would help us to spread the awareness and take a step against these companies. Also spread the message through mails across your company employees. You can take the content from the IT/BPO Voice of India | Facebook group(You don't need to join to see the content)
