Hi ,
I joined HCL technologies for a project with vmware , the proect got shelved and I am on bench from past 1 month. i got an offer outside and they want me to join immediately.But my manager and HR are not releiving me saying its 3 month notice period .please help

Following are the alternaties before you.
1. Pay & deposit 30 days salary in lieu of your notice period and serve 30 days in your present company (Check & refer your offer of appointment letter).
2. State clearly to your prospective employer that you shall be relieved by your present company only after serving 60 days notice period.
And seek extention in your joining time.
Based on the replies received, decide yourselves.

Hello Everyone,
I work in an IT company, want to know that does companies allow Leave without pay in probationary period. If yes then how many? Is it under rules & regulations of Shop & Establishment Act. I want to make this policy in my company's rule so please share your Ideas & information as soon as possible.

As regards Leave, there is no rules under any Act (Certain Acts stipulates no of days leave to be given to employees.
For e.g. Factories Act, Shops & Establishments Act etc). Leaves to be administered based on individual companies'
leave policy.
There is no harm in giving leave during probation period, but limit such leaves as one day per month.(As a general rule
during the first three months of probation, no leave. Remaining part of probation period, only 1 day/1 month. If more than
1 day is avaled by employees during probation, start effecting loss of pay.
Evolve a leave policy which is best suited to your company.

Hello friend,

First thing you can request to your future employer and discuss your present situation. If possible ask them to give you a bit more time to settle down this issue. and then come back to your present employer and talk to your reporting manager regarding this.and approach him emotionally as well as if you were a good performer and had good relationships with your Sr. then this is the right time to ask them for favor. Talk to HR person and assure him that you will handover your all responsibilities properly and surely always available if co. needs you in future. request him and ask him if there is any option to settle down this one month Notice period then pay for it and get your relieving letter. Always stay calm during talk on this issue and show your patience and sweet nature to them all the time. work a bit hard. I am sure you'll get your letter. hope for best and keep trying.

Please check every point of your offer letter or any policy which you had signed or co. had informed you in past. that will be helpful for you in this issue. if there is any loose point then take strong stand on that but with calmness. I am sure these all terms and conditions will be there in offer letter.

Hi Rajkumar, I am just advising you that its not about HCL comnet. Its about any corporate co. if you leave before 6 months without any genuine reason like health issue family personal issue then except this your next employer will count it your in competency towards job. Because HCL is a big name, one will not leave like that specially fresher just after 4 months. now after 5 months still you are searching. I would advice you to start your carrier as a fresher again because if you'll buy that experience from HCL, i don't think you will do something with that. you'll be hired as a fresher again anywhere. without letter you can show your experience with the knowledge of that profile in interview. good thought. 30 days is also very much. it should be 15 days. now have you ever thought about the situation when employee leave the job just like with in 1-2 months of joining or sometime they even don't join after very positive follow up they denied in last minute of joining. I hope you also have thought about the employees just want to grab good opportunity don't even think about the present company or profile and just want to settle down the N,P minimum as much as possible. Don't you think these all situations should come under some terms and conditions. Dear its up to the candidate during joining process that what he or she is going to sign. HR always clear every term and conditions to the new joiner. Retention is the biggest issue in today's era. and small and mid level companies face problems when employees suddenly left the organization. So, these are are sometimes necessary if we think from co. point of view and unreasonable when we think as an employee. But with mutual understand in most of the cases it settle down.

There is no point to discuss. as you said it's clear in your offer letter that one can buy the notice period and you are ready to pay for 2 months then they can't force you to do work more. just talk with them politely and with mutual understanding it'll be settle down.

Please check out your project offer letter which you got. reply them acc. to the terms and conditions. request to HR that its a loss of your carrier growth so plz try to understand the situation. in the meanwhile they should search one who can replace you. check out what are the consequences not to serve the 3 months N.P.

Agree with Mr. Nair. You can make rules as per the co. policy. It can be like in 1st month leave is not allowed after that 1 or 1nd half leave employee can take. or first 3 months they are not entitled any leave after that no. of leave one can enjoy as per company rules.
