We are a company with 40 employees. We took ESIC registration one year after we crossed the ESIC limit. We are on track now, but we want to pay all our dues, damages, and interest before receiving any notice from ESIC. How do I do it online? There are so many sections like C 18 I and D 18, and Actual and Adhoc. I am unable to understand which head I should put what.

Please do give me guidance on the same.

It is very nice that your establishment wants to clear dues of ESIC. However, in the remarks, you have not mentioned whether your establishment has received any notice from ESIC for the payment of damages and interest on late payment of contributions, if any. Furthermore, the words C-18 or D-18 are the forms used by the ESIC to claim certain pending dues from employers. I am not sure about the online procedure for the assessment of such pending dues.

As I understand, you cannot deposit the amounts of damages at your level since these are to be firstly assessed by the authority under the ESI Act, 1948. If your establishment desires, you can write to the above department (indicating your code number and date of coverage) to intimate your establishment's pending dues, if any, including interest and damages.

Good to see that your organization is ready to pay the dues without hesitating or hiding anything else. I appreciate this.

In this case, you may request the Regional ESIC commissioner or inspector that you want to have the ESIC inspection done for your organization. Your organization has become eligible for ESIC, but due to some administrative reasons, it could not get registered on time. Therefore, with goodwill and good intentions, employees should not suffer in terms of benefits, and the organization does not want to default on due payments to the authority.

You will receive a ready-made inspection report with the due amount, authorized by the ESIC authority itself. Hence, you do not need to take any action on it, and you will also have the opportunity to reduce the penalty to some extent. By requesting the inspection personally and showing good intentions towards social security benefits, there are chances to mitigate penalties.

Sir, I have pending contribution forms from Nov 2013 to Sept 2014. We have already created challans in the month of Sept 2014. Due to some financial problems, we failed to deposit these payments. Now, we want to deposit the payment, but our challans are not being accepted by the bank system. Please take necessary action to solve our problem and help us.
