Maternity Benefit Act, 1961 - Right of Maternity Benefit
Please refer to the provisions of the Maternity Benefit Act, 1961. Every pregnant working woman in any establishment is eligible for Maternity Benefit, provided they have served in the establishment for at least 80 days in the twelve months before the expected date of delivery. However, if a woman is earning less than Rs 15,000, she may be offered the ESI scheme by her employer and will not be eligible for maternity benefits, but she will receive Maternity Benefit under the ESI Scheme.
Note: No working woman shall be entitled to maternity benefits unless she has actually worked in an establishment of the employer for a period of not less than 80 days in the twelve months immediately preceding the date of her expected delivery.
Therefore, I suggest you go through the Act and refer to your establishment as per labor law.
