The subject does not match the content. The annual return in forms L, M, and N to be furnished by the employer under the Maternity Benefit Act is to be filed on or before the 31st of January every year. The forms are attached for reference.

You are right, my subject does not match with the content. It was a typographical error. I am sorry for that. Anyways, thanks a ton for the forms (annual returns under MB Act). Please clarify the following:

1. Do female employees under the MB Act include contractual female employees (housekeeping, gardening)?

2. The total strength of female employees directly employed on the payroll is 14. I believe this is well below the limit of 30. Please correct me if I am wrong. In this case, do we need to file the returns even if the total female employee strength is below the limit?

3. Do all three forms need to be filled separately or are they to be filled together?

Please respond to this. I am sure you will guide me on this.

If the housekeeping/gardeners are employees whose names appear in your muster roll and EPF/ESI are deducted and paid by you, they are entitled to maternity benefits. Maternity benefits are payable even if the company employs only one female employee. All the forms are to be filed together.

Is it mandatory to file an annual return (Form L, M, N, O) under the Maternity Benefit Act when ESI is applicable? There are a few females who are out of the coverage of ESIC, but if anyone has not taken maternity benefits, do we still need to file a "NIL" return under the Maternity Benefit Act.

Dear all,

Please note that ESI Annual Returns have to be filed before 31st January 2013. Annual Returns are the information you have to provide regarding the employer only, and employee details are not required.

Dear Gangadhar ji,

You are absolutely correct. According to Regulation 10C, every employer in respect of a factory or establishment to which this Act applies and to whom a code number has already been allotted shall furnish to the appropriate Regional Office, Sub-Regional Office, or Divisional Office by the 31st of January every year, a return in Form 01(A). The employer shall be responsible for the correctness of all particulars and information furnished in Form 01(A).

Please find attached a Form 01(A) for the ready reference of all the members.
