Can an employee be fired from a company after using his time and capability for more than 8 months, even though he has not committed any mistakes or has performed his duties very well?

Just by a conspiracy made against him and not utilizing his capability after that time, can we change his profile? The guy was a good stenographer and now is just doing the job of a dispatch clerk. He is a colleague of mine, and I need to help him. What should he do if he is fired without any mistake on his part?

In the U.S., unless the employee has a specific contract, he or she is an "At will" employee, subject to dismissal at any time for any lawful reason, without recourse.

I'm not familiar with Indian employment law, but he or she should certainly contact an attorney to determine whether or not he or she has some legal rights that are being trampled.

Dear Ms. R,

If he has worked for more than 240 days (continuous service as defined in the act), then under the ID Act (which will be applicable in this case), he can claim permanent employment. If dismissed, he can raise an industrial dispute. He will also be entitled to retrenchment compensation.
