Resolving EPFO Exit Date Error and Addressing Potential Background Verification Issues - CiteHR

I had briefly worked with an organization (Company 1) from 17 September 2018 to 30 September 2018 (for 2 weeks only).
Unfortunately, I had to discontinue my employment due to Low salary, for which I left the organization and joined with another offer (Company 2) with joining date as 1st Oct 2018.

My last working day with Company 1 was 30 September 2018. After that I did not work in October 2018, nor do I possess any pay slip for that month or experience letter. They sent absconding mail by saying I resigned with short notice and without informing, whereas I informed then verbally that I am going to hometown. I had to join immediately to the Company 2. All of these were happening in October, and Company 1 did not give salary but credited PF for Oct.

Now in my EPFO portal, I noticed that my exit date has been recorded as 31 October 2018 instead of 30 September 2018. It appears that a PF contribution was credited for October, which I was unaware of until recently.

This discrepancy is now affecting my UAN service history and may lead to complications with future PF claims or job search. Your suggestion on how to change last working date of Company 1, at the earliest would be greatly appreciated.

It's crucial to correct the discrepancy in your EPFO records to avoid any future complications. Here are the steps you can take:

1. Contact Company 1's HR Department: Explain the situation to them and request them to correct the exit date in the EPFO records. They should be able to do this since they are the ones who submitted the incorrect date.

2. File a Grievance: If Company 1 is unresponsive or unwilling to correct the error, you can file a grievance with the EPFO. Visit the EPFO grievance portal https://epfigms.gov.in/ and fill out the form with all the necessary details. Make sure to clearly explain the issue and provide all the relevant details like your UAN, Company 1's establishment code, and your employment dates.

3. Legal Action: If the above steps don't work, you may consider taking legal action. Consult with a labor law attorney to explore your options.

Regarding the background verification for future employment, be upfront with potential employers about the discrepancy. Provide them with all the necessary details and evidence to support your claim, such as emails or any other communication you had with Company 1 regarding your resignation. This will help to mitigate any potential issues during the background verification process.

This can be rectified only by approaching the PF office concerned and giving clarifications like bank statement etc. Obviously, the company should also be given an opportunity to be heard, and at that time, you can also ask for proof of you having worked in October 2018. You can ask the company to produce pay slip for the month of Oct and also credit of salary given. You should challenge the act of employer as victimisation and purposeful act to spoil your career.

You can try using the grievance field available in the PF website. But I am not sure if it will give any result. But still, to start with, you may file the complaint, rather grievance, through the portal itself, and wait for the results. If no response is coming, you may approach the Asst. PF Commissioner and submit a written compliant.

  • Exit date rectification can be done by submitting joint declaration form manually at epfo office.
Because the sept contribution is usually paid by 15 oct, Your company 1 ,therefore might have exited you on 30 oct.So in my view, this can be resolved if you submit joint declaration form,if incase the company 1 refuses to sign joint declaration,You can approach epfo for further guidance

  • Based on your query, it seems there is a discrepancy in your last working day in company 1 as recorded in the EPFO database. This discrepancy is due to the PF contribution credited for October, which you were unaware of. Here's what you can do to rectify this issue:

    Step 1: Contact Company 1
Your first step should be to contact Company 1's HR department and explain the situation to them. Request them to rectify the last working day in EPFO records. If they agree, they can make the necessary corrections from their end.

    Step 2: Joint Declaration Form
If Company 1 is unable or unwilling to make the correction, you can submit a joint declaration form at the EPFO office. This form needs to be signed by both you and your employer. However, if Company 1 refuses to sign this form, you can approach the EPFO for further guidance.

    Step 3: Approach EPFO
If Company 1 is not cooperative, you can directly approach the EPFO with your issue. You can do this by visiting your nearest EPFO office or by raising a grievance online on the EPFO grievance portal (https://epfigms.gov.in/). Provide all the necessary details and supporting documents to make your case strong.

In the future, to avoid such issues, always ensure to serve the required notice period and obtain a relieving letter or experience certificate from your employer before leaving the job. These documents are crucial for smooth background verification in your future employment. Also, keep track of your EPF contributions and check your EPFO account regularly for any discrepancies. If you notice any issues, address them immediately with your employer or the EPFO. Remember, it's your right to have accurate records and to be treated fairly by your employer. Good luck!
