If an employee gets a fitness certificate to resume his duties after being on ESIC leave for almost 8 months, is it necessary to let him resume his work, or can we terminate him? Please help me out in this regard.

On which grounds can you terminate him? There should be some valid ground for termination. ESI leave is not a ground for termination.

If employee has notified you by submitting the ESI leave letter for the said period then you can’t terminate him by considering his absence as the reason
