Can anyone solve my query regarding the employee who has returned from ESIC leave but is unable to work in my company? What should I do in this situation? He is not able to perform the tasks required by my company. I need to address this issue, but what is the next step? Should I terminate his employment because he does not meet the qualifications for this job?

Please get it certified from ESI doctor that he is unable to work & till he becomes fit ask him to again go on Sick Leave under ESI / LOP either may be the case.

As per law, if he is not able to perform such job, company should assign other job which he can perform OR other way is to make some settlement with him for putting resignation.
