I have some doubts, that's why I am asking you some of my queries.

1. Can someone resign from their service at any time if they have a health issue?

2. If someone has been assigned some work but suddenly faces health issues, can we relieve them immediately?

Kindly help me urgently.

Replies to your questions are as below:

Can someone resign from their service anytime if they have some health issue?

Reply: Health issue or otherwise, you may resign anytime subject to the fulfillment of the terms of separation mentioned in the appointment letter. Have you signed any bond for serving some years? If yes, then you need to complete the bond period also.

If someone has been assigned some work but suddenly has some health issues, can we relieve them immediately?

Reply: If you are medically unfit to execute a certain type of work, then obtain a medical certificate to this effect and submit an application for the exemption of that work. Explore the possibility of working in some other department or section. Yes, you may resort to separation from the company but subject to the conditions mentioned in the above paragraph. Going further, explore the possibility of taking Leave Without Pay (LWP) for a few weeks/months. Once you become medically fit, obtain a medical certificate and rejoin your duties. However, your company may not agree to this, but there is nothing wrong per se in asking for it.

Yes, one can resign from their service at any time as per their wish; one reason may be health, among many others.

If someone resigns after being assigned work due to health reasons, it implies that the person is not capable of handling the new task and is seeking an excuse. You can conduct a health check with your own doctor or hospital to verify the truth. It is advisable to release the person immediately if they have health issues. You can suggest that they provide medical test reports and a doctor's referral for early relief.

Actually, that person had a panic attack and just fell down after his boss scolded him in front of 50 employees, telling him, "If you can't complete this task, I will kill you." After this, he started shivering. In this case, can he resign from his service because he has not signed any contract?

First of all, the boss is at fault for saying, "I will kill you." Public humiliation is not a good technique and is counterproductive. If both the employee and employer are in agreement, let him exit peacefully and with his legal dues as per the employment letter.

Dealing with a Difficult Boss

A boss might exhibit dictatorial behavior, similar to historical figures like Hitler or Saddam, with violent tendencies. If he is a leader, the approach could be different. It is wrongful on his part to shame an employee in the presence of other colleagues, as this will further distress the affected employee. Instead of working under such a person, one might as well consider staying at home, doing nothing.

Handling Mistakes and Encouragement

Making mistakes while performing jobs is inevitable; it happens to everyone. Nobody is perfect. The affected individual can be encouraged to quit and join another company where there is a positive environment for learning and working, where efforts are appreciated, and where guidance, coaching, training, and motivation are provided.

Developing Assertive Skills

There is no need for the employee to prove their medical fitness or otherwise. Even if there is a loss of ten days' salary, it does not matter. Let the individual develop assertive skills, communicate their views clearly and properly, and not allow themselves to be bullied by bosses. Such bosses may not last long. One fine day, a smart individual will emerge from the crowd, turn around, tell the boss to get lost, and walk out!
