Request for Assistance with Transfer Issue

Can any of you guide me to overcome one of the biggest problems I am facing right now? I have received a transfer notice, assigning me to the Kolkata Region for the survey and setup of new branches in Sikkim and Jalpaiguri District, West Bengal. Top management is fully aware that my wife has been diagnosed with breast cancer recently, and her treatment is ongoing at Dr. B. Borooah Cancer Institute, Guwahati. She is undergoing chemotherapy, which needs to be repeated every 21 days, and we need to care for her throughout this process.

During this critical period, my wife, our two young children, and I are facing significant challenges in treating and curing her cancer. My family needs me the most at this time. I need to stay at my present location to care for my wife and look after the welfare of my two children, aged 4 and 9. Previously, the company did not provide me with any financial support for my treatment after a major accident during official duty in February 2016. My leg has not completely recovered yet, and my current condition restricts my movement.

Considering these circumstances, I requested the company's MD to allow me to work and open new branches by visiting from Guwahati instead of being stationed in the Kolkata Region. However, they have not agreed to my proposal and have asked me to go to Kolkata. I have no issues of fraud or misconduct in the company. I feel harassed and am looking for any solution.

Addressing Harassment Due to Transfer During Wife's Cancer Treatment

🔍 Assess the Legal Perspective:
- Review the labor laws and company policies regarding transfers, harassment, and compassionate leave in India. Ensure you are aware of your rights and protections under the law.

📝 Document the Situation:
- Keep detailed records of all communication with the company, including your transfer notice, medical reports of your wife's condition, and any previous incidents where support was denied.

🤝 Engage in Constructive Dialogue:
- Schedule a meeting with HR or higher management to discuss your situation calmly and professionally. Clearly explain the challenges you are facing and the need for flexibility during this critical time.

💼 Propose Alternative Solutions:
- Offer practical alternatives such as working remotely, delegating tasks, or temporarily assigning someone to handle the responsibilities in Kolkata while you oversee from Guwahati.

📅 Seek Temporary Accommodations:
- Request for a temporary suspension of the transfer until your wife's treatment stabilizes or explore options for a short-term assignment closer to Guwahati to balance work commitments with family responsibilities.

📜 Invoke Company Policies:
- If the company has specific policies on compassionate leave or employee support during medical emergencies, ensure they are aware of these and advocate for their application in your case.

💬 Seek External Support:
- Consider seeking advice from legal advisors, employee unions, or support groups specializing in workplace rights to understand your options and receive guidance on how to navigate this challenging situation.

Remember, open communication, documentation, and exploring viable solutions can help in addressing the harassment you feel due to the transfer notice during this critical period.
