I read section 52 (Weekly holidays) of Factories Act, 1948. But i not get specific idea for this topic : - "If the factory manager open the industry on weekly off and call for duty to any worker or staff employee". This is right OR wrong as per act ?
In this topic please suggest me - which specific Act and Section applicable for - "Factory Manager need to taken approval from Labour Department before 3 days with valid reason.and compensate with in 3 days"

Dear Dee
Pls go through your state INDUSTRIAL ESTABLISHMENT NATIONAL HOLIDAY ACT,
( WHICH HAVE SPECIFIC PROVISION FOR GRANT OF HOLIDAY / PROCEDURE FOR PAYMENT AND FACTORY )
FURTHER AND IF THE EMPLOYER ENGAGE ON THAT DAY, ALL THE WORKERS SHALL BE PAID TWICE WAGES FOR SUCH DATE / DAY.)
BUT THERE ARE NO ANY PROVISION REGARDING ASKING APPROVAL FOR PLANT OPERATION BEFORE / OR PRIOR 03 DAYS .

Dear Dee win,
The answer to the first question is ''NO'' You can very well open the factory and work on weekly off.
Regarding permission for working on a holiday, section 53 gives some information and there by state rules are more clear on giving further directions in this regard.
Some state rules specify that we need to submit workers willingness and reason for depriving a weekly rest and intended compensatory off which you are going to give to the local authority before proceeding further.
Hope this will clarify your query.
