We are conducting the entry of the contract employees at our main gate. The supervisor of the contractor maintains his own record. By checking both records, we are maintaining a fair record. However, in this matter, our gate register serves as the main attendance system.
At the time of entry, it is the duty of the supervisor to be present five minutes before working hours at the main gate and to enter his employees in our gate register.

Can anyone focus on who is responsible for maintaining the attendance of contract employees: the principal employer or the contract agency? I request you to comment as per the applicable contract labour laws.

In my organization (where more than 600 contractors are working), we have adopted a five-layer verification system on a daily basis:
1. In the first layer, a representative of contractors coordinates for taking initials of each worker in the prescribed column of the register before and after the shift.
2. In the second layer, section-wise shop supervisors also maintain a record based on the physical presence of workers.
3. Daily, within half an hour of the starting of the shift, all shop in-charges and contractors forward their attendance report to the HR department.
4. The HR department compares both the reports. Proper investigation is carried out if any deviation is noticed in both the reports.
5. Besides the above, we in HR also conduct random surprise checks along with the representatives of contractors and shop floor in-charges. There is a foolproof system for the same. No doubt, the security department also plays an important role.

In one of my management audits, the auditor remarked that the principal employer is held responsible for maintaining attendance records, PF challans, overtime, etc., all relevant records. However, when I referred to the Contract Regulation and Abolition Act, it is clearly stated that for maintaining the records, the employer is not liable but is liable to pay wages, overtime, etc., as per the law. It is the responsibility of the contract agency to keep all the records, and for that purpose, they have been taken as contractors.
