Hi friends,

I want to know about the applicability of the ESI Act and the Factory Act in accident cases. In the ESI Act, Form 16 accident form is filled out. What about the Factory Act? Is the employer liable to provide an accident report under the Factory Act as he is submitting the report under the ESI Act?

yes u r under statutory obligation to send the accident report to the directorate of Factories and form No. is 18 under factories Rules

Hi All,

I am working as an HR in a company. One of our employees has left the organization without serving the notice period. He was on probation period and worked for only 1 month. Now we have sent a letter to him, requesting him to pay a certain sum of money as he had not served the notice period. Now I want to know, can we take any legal action or any action if he is not paying the money. The amount is $7800, which he is supposed to pay. Please advise.

Dear Kinkar,

Can I know what is the amount of 7800? Have you paid any advance salary? As he is in the probationary period, he can leave the company without serving the notice period, but let me know whether he is absconding or has been relieved properly.
