Dear all,

I am in confusion as to whether there is any limit on how many times a woman can avail maternity leave as per statutory laws. Is it only once, twice, or irrespective of the number of children?

Hi Rahul,

As far as maternity benefits are concerned, they will cover two live births and fully paid leaves for a female employee can be a maximum of up to 12 weeks - 4 weeks prenatal and 8 weeks postnatal. In the case of a miscarriage, paid leave can be up to 6 weeks.

Condition: The employee should have rendered continuous service of 80 days preceding the date of delivery.

Dear Mr. Sardhar,

I have gone through the link you have provided, but it doesn't provide me the solution I'm looking for. I want to know if there is any limit to how many times a female employee can avail maternity benefits in the same organization, provided she fulfills all other conditions. Someone mentioned that it is limited to 2 live births... is that true?

Hi Rahul, As per Maternity Benefit Act/ESI Act only upto two live birth a female employee can claim maternity benefit. Regards, "A"
