Role of Factory Inspector in Case of Fatal Accidents

In the event of any fatal accident within the under-construction factory premises, what is the role of the Factory Inspector? Can the inspector impose penalties?

If the factory is under construction and it is within the running factory premises, then the factory inspector has the power to inquire about the accident and instruct the contractor to take necessary remedial action through the principal employer. If the premises are under construction and the manufacturing process has not commenced, then the factory inspector has the power to inquire about the accident as he is the competent person appointed by the BOCW Act of the concerned state government.

Hope that the penalty cannot be imposed on the contractor or principal employer, but he can instruct the contractor to pay the Workmen's Compensation amount, leave pay, gratuity amount, and in addition, he can pass an order to pay ex-gratia to the deceased workman.
