Dear NK,

For statutory compliance for your Gurgaon (Haryana) factory, you can adhere to the grant, accumulation, and encashment of earned leaves in accordance with Chapter VIII on annual leave with wages as provided in the Factories Act, 1948. For the grant of CL, SL, and National and Festival holidays, you are to follow the PIE (National and Festival Holidays and Casual and Sick Leaves) Act, 1965, as applicable to the state of Haryana. For the grant of maternity benefits (leaves), you should refer to the Maternity Benefit Act, 1961, and the rules made thereunder.

For your Delhi Corporate Office, grant leaves as per the Delhi Shops and Establishment Act, 1954. In my opinion, a leave policy is required to be framed when we are to allow some better facility compared to applicable enactments. If we want to create a uniform leave policy for both places, i.e., the factory and office, then review the applicable enactments for both locations and adopt leaves that are on the higher side to avoid non-compliance for either place.
