I would like to ask for advice on the following:

Explaining the whole story:

One of my subordinates asked for vacation where she already purchased the ticket prior to my approval. However, I had to reject her vacation due to operational reasons and not meeting the annual leave policy. Last week she reported sick and sent me a medical certificate to the office for only 2 days. She did not come back for the rest of the week, stating she is still not feeling well. She did not call me, just texted. So, I became suspicious that she went on that holiday, and she did!

Anyway, when she filed her vacation request, she submitted her request along with the ticket printout. My HR assistant is her friend. So, when I came back to the office after the weekend, I wanted to check the flight number when she has flown to get the proof. However, the ticket and vacation request are missing!

So, my question is, I want to terminate both of them for absconding and dishonest and unethical conduct, and my assistant for disclosing company secrets (she has leaked some info before as well).

Can I process immediate termination? For my assistant, I am positive that I can because she breached confidentiality. However, the other one I am not sure. Please advise!

As per the UAE Labour Law, an employee employed under a contract of unspecified terms resign after a continuous service of not less than a year and not more than three years is entitled to one-third (i.e. seven days) of the end of service gratuity. If the period of continuous service was more than three years and less than five years, he is entitled to two-thirds (14 days) of the gratuity. If the service is more than five years, then from the fifth year onwards, he is entitled to gratuity of 30 days per year, provided that the total gratuity shall not exceed the wages of two years. Therefore, after the completion of your third year in the job, your gratuity shall be calculated 21 days (i.e. your one-day’s salary multiplied by 21) will be your third year’s gratuity. If you resign before the completion of the third year, you are entitled only for seven days gratuity.

Besides, the end of service gratuity is based on the basic of the last salary without adding any benefits or allowances of any kind as per the terms of Article (134) of the Labour Law.
