A foreigner can be employed in India provided he possesses a valid work visa. A foreigner is also covered by EPF, the details of which are available on the website of the Employees' Provident Fund Organisation. There are a sufficient number of postings on this forum regarding this matter.

Firstly, it becomes necessary to check if there is any agreement between India and the country from where the employee is coming, and whether there are any terms decided by the countries to employ each other's citizens. Recently, the central government has passed a resolution regarding the payment of PF Contribution concerning foreign employees in India. According to this resolution, the PF contribution of foreign employees is to be deposited with PF authorities in India. However, when disbursing the PF amount to such an employee after his termination, etc., the decision is to be made according to the provisions of the international agreement with his country.
