Dear All,

My employer is not ready to release me, so I am leaving the company without full and final settlement. Probably, they will not sign and validate my PF withdrawal form in the future, so my PF will get stuck. Kindly suggest what to do?

Hi,

There is a governing body for these kinds of issues, and in this case, the Regional PF Commissioner is the right person to approach. I have witnessed a similar issue where an employee approached the Regional PF Commissioner, and the Commissioner asked the HR department and the candidate to settle the issue. Afterward, the PF was cleared. You can visit www.epfindia.com and find the correct contact information. If you are in Delhi, please let me know as I have the contact details.

Dear,

As per Section 10 of the PF Act, it cannot be attached against any dues, so no one can stop your PF. You can deposit the form directly to RPFC with an application stating that your employer is refusing to sign. Under Section 68 of the PF Act, RPFC will send this form to the employer, and he is bound to verify and return it within 8 days of receiving.

Thank you.

Hi all,

I had my PF account in my first job in 2004 and worked for a company for about 5 months. I completed all the settlements when I left the job, but I haven't withdrawn my PF amount. Can I withdraw it now? If yes, the company has an office in another location. What's the process?

Thank you.

Dear Avinash-Babbil,

I would suggest that you submit your resignation to the HR Department and ensure you receive a copy of the resignation letter. You will be able to transfer your PF to the new company without requiring any signatures from your previous employers. As you are a government 2nd-class officer, you have the authority to withdraw your PF.

Please let me know if you need any further assistance or clarification.

Thank you.
