I joined a US based organization on 26th Oct 2014,The organization mentioned in their appointment letter that i will be on training for 3 months,they gave me 3 weeks of training but the training module was not related to my job and after that training they directly put me on live work and that working i started doing that work as per the direction given by my Mentor.I always asked to my mentor am i doing good,She said yes you are good.Now suddenly they told me we are not satisfied with your performance and we are terminating you,I asked them what is the reason but they told me you are not doing good.Without any reason they are terminating me.I want to file a case against the organization.
Can i do this ?

How much it will cost me ?

Hi Rahul,
Clarify one thing did they mention on your appointment letter after training only they can confirm your employment. Read out the letter completely and from my point of view it is wasting of your time by filing case against them. you have to speak with your employer and if they are not willing to explain then get your salary for those working day and try better opportunity.

Dear Rahul Raja,
Please go through the offer of appointment, in case there is a provision that your training can be curtailed before completion of training period there is no other way but to relief have to be accepted.. in case otherwise there is no such provision in the offer of appointment you can lodge your complaint with the authorities..

There are certain things need to understand
Have they provided a clear JD duly signed by you
Does it mention your job description and key result area / KPI
Have they informed you in writing in details that you are not performing and have they given you proper reason in details
If not, you may approach assistant labour commissioner's office but before that speak to the organisation and ask them to justify the action.

Please read out the appointment letter fully. In your appointment order any one clause says like your training period will be terminated without assigning any reason or notice means you can not file case against the company. Because definitely you might have singed in the duplicate copy of the appointment order.
My opinion is the clause is favour of you also do not file case against the company it will spoil your career. If any salary dues or experience letter is pending with the company get it first and search for a new job. Because once you joined new company they may verify conduct and services with that employer.
