If there is any dispute regarding the F&F you can approach the Labour department and deposit the amount payable with the DLO, if required. This is very important if the F&F includes gratuity payable. But if the dispute is with regard to amount of insurance or the claim settlement of the bills produced in support of the mediclaim policy, then you should involve the service providers of the insurance.

Hi,
First of all ascertain who are all the legal heirs for the deceased employee after verifying all legal documents like legal heir certificate and other proof like Marriage certificate. Arrive at the full and final settlement amount in equal proposition. Inform and get their consent over phone. Execute receipts party wise and also a declaration in 100/500 Rupees stamp paper wherein all parties to sign that they accept the full and final settlement and will not make any other claim in future.
In general spouse/children are legal heirs and if Mother of deceased is live she can be added as a Dependent and equal share can be given.

Hi
After ascertaining the legal heir, as per documents available on records with the employer, send a registered AD letter to his / her last known adress stating what all dues are payable in respect of the deceased employee, mention a particular date and time at which the legal heir is to be called in office. Mention what all documents are needed to be carried which ascertains him / her as legal heir.
Keep all the necessary documentation like letter, receipts etc ready.
If the legal heir does not respond or does not attend till the specific date, then can proceed as per mentioned by our esteemed members above.

You should involve the insurance company's service providers if the issue relates to the amount of insurance or the claim settlement of the invoices generated in support of the mediclaim policy.
